Having an Export Compliance Program is a Requirement

It is a requirement for businesses conducting exports of controlled products and services in the U.S, and Canada to implement and maintain an export compliance program.  These programs are required to protect the national security and foreign policies of the respective nations.  Failure to maintain a viable program can result in criminal and civil penalties, including debarment of the organization from future export activities.

U.S. Requirements for an Export Compliance Program

Export regulations for controlled goods and services in the United States primarily fall under either the International Traffic in Arms Regulations (ITAR) or the Export Administration Regulations (EAR).  The ITAR, which is administered under the Directorate of Defense Trade Controls, controls military articles and services has slightly more requirements that the EAR which controls dual use items which have both commercial and military applications.  Both sets of requirements, however, have common requirements for compliance programs.

While ITAR and EAR are the primary regulatory requirements, various governmental agencies place sanctions against nation states and denied parties.  Businesses should always check any party given access to controlled goods against denied parties lists.  There are over fifty different lists maintained by U.S. government agencies to prevent goods, services, and technical information from falling into the wrong hands.  These lists are administered by the following agencies:

  • Bureau of industry and Security
  • Directorate of Defense Trade Controls
  • U.S. Department of the Treasury’s Internal Revenue Service (IRS)
  • U.S. Department of Treasury’s Office of Foreign Assets Control (OFAC)

Canadian Controlled Goods Program (CGP) Requirements

Registrants of the Controlled Goods Program (CGP) must comply with numerous requirements.  They must have an export compliance program that is lead by designated officials within the organization.  They must conduct security assessments for any party that may examine, possess, or transfer  controlled goods or technology.
 
Additionally, organizations that fall under the CGP must develop security plans.  These security plans should include procedures to control access to controlled goods, identify individuals responsible for security, training programs for personnel at all levels, briefings given to visitors, and procedures for reporting security breaches.
